Terms of Service

1. Acceptance

These Terms govern your access to and use of the Services. By using the Platform, registering an account, or clicking "I Accept," "I Consent," or any equivalent confirmation, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. Such actions constitute valid acceptance with the same effect as a signed written agreement. If you do not agree, do not use the Services.

SwiftFi is a technology company, not a bank. Accounts are not insured against loss. If a Partner provides a specific policy for a service, that policy applies to that service.

2. Services and Partners

Services include the Platform, Partner Services, and related software, content, and features we make available. Some regulated services are delivered by Partners and may require separate acceptance of Partner terms and verification.

We may modify, suspend, or discontinue any Service at any time.

3. Eligibility and Registration

Registration is required to use the Services. You must provide accurate contact and account information. We may refuse to open, activate, suspend, or close an account at our discretion. You may only maintain one account at a time, and you must only create and use an account that is rightfully yours.

To use the Services, you must:

  • Be at least 18 years old (or the legal age in your country), or register on behalf of a legally constituted entity you are authorized to bind
  • Have legal capacity to enter a binding contract
  • Provide accurate, complete, and current information and keep it updated
  • Not be located in, or a national or resident of, a restricted or sanctioned jurisdiction
  • Not appear on denied persons lists
  • Not have been previously suspended or removed from the Services
  • Not be under a legal restriction that prevents you from using the Services

You are responsible for ensuring that your use of the Services complies with laws applicable to you. We may update restricted locations without notice. If you register for an entity, you confirm that you and the entity comply with these Terms.

4. KYC, AML, and Compliance

Access to Services may require identity verification and ongoing screening (KYC/AML) under applicable laws and Partner policies. SwiftFi maintains a compliance program that includes customer due diligence, transaction monitoring, and periodic reviews. You agree to provide requested information and documentation at onboarding and on an ongoing basis. Access may be denied if you do not provide required identity proofs or if documents do not satisfy SwiftFi or Partner criteria.

As part of our compliance obligations, we may send you a Request for Information to verify the source of funds, the purpose of a transaction, your relationship to a sender or payor, or your relationship to a destination wallet. Acceptable documentation may include, but is not limited to:

  • Pay stubs or employer earnings statements
  • Invoices, contracts, or statements of work
  • Official bank statements showing originating transfers
  • Other records that clearly indicate the source of funds
  • Written explanations of transaction or withdrawal purpose

We do not accept screenshots (including wire or payment confirmations) for compliance purposes. Failure to provide required information within stated timeframes may result in delayed settlement, holds of at least seven (7) business days, limited access, suspension, or termination. 5. Account Security

You are responsible for protecting your credentials and for all activity on your account, whether authorized by you or not. Do not allow third parties to use your account. Instructions or transactions made with your credentials are treated as made by you. Notify us immediately of unauthorized access at support@swiftfi.com.

6. Fees and Charges

Fees are displayed on the Platform and before you confirm a transaction. Fees may include transfer fees, network fees, third-party fees, or conversion spreads where applicable.

Partners may assess additional fees under their own terms.

7. Virtual Assets and Custody

When you transfer Virtual Assets or fiat into SwiftFi, the transfer is treated as a sale of Virtual Assets to SwiftFi. You no longer own the Virtual Assets after sale. SwiftFi records a USD-denominated ledger entry at the prevailing market rate for settlement purposes; it is not a deposit or stored-value account.

  • Acceptable tokens currently include USDC and USDT
  • Acceptable tokens may change without notice
  • Transfers may be delayed or declined for compliance

Custody and settlement services may be provided by Partners or custodians. SwiftFi may instruct custodians to freeze, convert, or transfer assets for settlement or compliance.

8. Transaction Timing

Transfer times vary by payment method, jurisdiction, compliance checks, and Partner processing. Timing is not guaranteed.

9. Prohibited Activities

You agree not to use the Services for illegal activities.

  • Money laundering or terrorist financing
  • Fraud, theft, or other criminal activity
  • Sanctions or export control violations
  • Uploading malicious software or abusive content
  • Providing false or misleading information

10. Third-Party Services and Data

SwiftFi provides the Platform as a technology layer. Regulated and operational services that enable payments, settlement, custody, identity verification, and related processing are delivered by third-party providers and Partners. Those providers operate under their own terms and policies, which apply when you use the affected Services. We do not control, and are not responsible for, third-party performance, availability, or decisions.

We use HIFI to process financial transactions. By using our service, you also agree to HIFI's Terms & Conditions and Privacy Policy.

11. Partnership and Affiliate Programs

SwiftFi offers a voluntary Partner Program for firms and creators, and an Affiliate Program for individuals and early-stage businesses. These programs are separate from payment, custody, or other service Partners described elsewhere in these Terms. Participation requires application and acceptance at SwiftFi's discretion.

Program rewards, including milestone bonuses and a share of referral transaction volume, are as published on the Partner Program and Affiliate Program pages. Reward amounts, eligibility criteria, and payment timing may change. Earnings are not guaranteed.

Program participants are independent contractors, not employees, partners (in the legal sense), or agents of SwiftFi, and may not bind SwiftFi or speak on our behalf unless expressly authorized in writing.

When promoting SwiftFi, you agree not to:

  • Send spam or engage in unlawful marketing
  • Make false, misleading, or unverified claims about SwiftFi
  • Impersonate SwiftFi or misrepresent your relationship
  • Engage in fraud, self-referral abuse, or other manipulation of referrals or rewards

You may use SwiftFi brand assets only as we authorize. You are solely responsible for any taxes arising from program rewards.

We may suspend or terminate program access for violations of these Terms, compliance or risk reasons, or at our discretion. We may withhold or reverse rewards for invalid, fraudulent, or ineligible referrals.

12. Suspension and Termination

We may suspend or terminate your account for violations of these Terms, compliance requirements, or risk management reasons. We may restrict or delay withdrawals to complete required checks.

13. Intellectual Property

All trademarks, logos, and content on the Platform are owned by SwiftFi or licensors. You may not copy, modify, distribute, or reverse engineer any part of the Platform without permission.

14. Disclaimers and Risk

The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access or error-free operation.

Virtual assets are volatile and involve risk. You are solely responsible for assessing whether the Services are appropriate for you.

15. Limitation of Liability

To the fullest extent permitted by law, SwiftFi is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities.

16. Indemnification

You agree to indemnify and hold SwiftFi harmless from claims, damages, or expenses arising from your use of the Services or violation of these Terms.

17. Governing Law

These Terms are governed by the laws of Florida, USA. Any disputes will be resolved in the courts of Florida unless otherwise required by applicable law.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Continued use of the Services constitutes acceptance.
